The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. Kurrâ’ya nispet edilen aynı kelimelerdeki edâ farklılıklarının tartışmalara sebep olmasından ötürü kıraat ihtilafı olan kelimelerde ihticâc yapılmasına gereksinim duyulmuştur. Delil getirmek manasında kullanılan ihticâc kavramı, kıraat ihtilafları için söz konusu olduğunda ise kıraat ihtilaflarının sıhhat zemininin ortaya konması kastedilmektedir. Ayrıca 2. asrın sonlarında kıraat tevcîhlerinin yapıldığı müstakil eserler ortaya çıkmakla birlikte kıraat alan yazınına ait genel telifatlarda da kıraat ihticâclarının yapıldığı görülmektedir. Kıraat müelliflerinden biri olan İbnu’l-Cezerî de Neşru’l-ḳırââti’l-‘aşr adlı eserinde zaman zaman kıraat ihticâcına yer vermektedir. Mezkûr eserdeki kıraat ihticâcları (...) hakkında tespit edilebildiği kadarıyla yapılmış tek bir çalışma bulunmaktadır. Fakat bu çalışmada, kıraatten ve bunun dışındaki disiplinlerden yeterince istifade edilmediği belirlenmiştir. Ayrıca selef ulemasının Neşru’l-ḳırââti’l-‘aşr adlı esere ihticâc konusunda etkisi özelinde bir çalışmaya da rastlanmamıştır. Buradan hareketle elinizdeki bu çalışmada, İbnu’l-Ce-zerî’nin kıraat ihticâcına dair uygulamaları Neşru’l-ḳırââti’l-‘aşr adlı eser özelinde incelenmiş, me‘âni’l-Kur’ân ve me‘âni’l-kıraat literatürlerinin ortaya çıktıkları dönem dikkate alınarak h. 2.-4. asırlarda kaleme alınan bu literatürlere ait eserlerin İbnu’l-Cezerî’ye ait kıraat tevcîhlerine etkisinin olup olmadığı araştırılmıştır. Çalışmanın neticesinde İbnu’l-Cezerî’nin yaptığı kıraat tevcîhlerinden ele alınanların bir kısmına, söz konusu üç asırda kaleme alınan me‘âni’l-Kur’ân ve me‘âni’l-kıraat telifatında ekseriyetle yer verilmediği saptanmıştır. İbnu’l-Cezerî’nin ise kıraat ihtilafının olmadığı yerlerde dahi ilgili edâ için ihticâc yaptığı müşahede edilmiştir. Buna ilaveten İbnu’l-Cezerî’nin Neşr’de yaptığı ihticâc uygulamalarının me‘âni’l-Kur’ân ve me‘âni’l-kıraat telifatında yapılan ihticâc işlemleriyle benzeştiği görülmüştür. Yine Neşr’in tevcîh eseri olmaması hasebiyle de İbnu’l-Cezerî tarafından yapılan ihticâcların ihtiyaç merkezli olarak kendini gösterdiği belirlenmiştir. (shrink)

We summarize searches for hypothetical particles such as supersymmetric particles, heavy bosons, axions, dark photons, etc. All the particle properties and search limits are listed in Summary Tables. We also give numerous (...) tables, figures, formulae, and reviews of topics such as Higgs Boson Physics, Supersymmetry, Grand Unified Theories, Neutrino Mixing, Dark Energy, Dark Matter, Cosmology, Particle Detectors, Colliders, Probability and Statistics. Among the 117 reviews are many that are new or heavily revised, including those on Pentaquarks and Inflation. The complete Review is published online in a journal and on the website of the Particle Data Group. The printed PDG Book contains the Summary Tables and all review articles but no longer includes the detailed tables from the Particle Listings. Previous findings demonstrate that people often do not feel how they want to feel, supporting the distinction between “actual affect” and “ideal affect.” But are there certain activities that reduce the discrepancy between actual and ideal affect? Based on flow theory and socioemotional selectivity theory, we examined whether the discrepancy between people’s actual and ideal positive affect would be smaller during activities that were more conducive to flow (a state of intense absorption and concentration), pleasant, and familiar. In Study 1, (...) U.S. participants aged 17–79 (N = 393) reported their ideal affect and how they felt during activities with varying degrees of challenges and skills. For both low-arousal positive affect (LAP) and high-arousal positive affect (HAP), participants reported smaller actual-ideal affect discrepancies during flow-conducive activities (when skills matched challenges). Study 2 was a 14-day experience sampling study, in which Hong Kong participants aged 18–83 (Nindividual = 109) reported their momentary actual and ideal affect, and how pleasant and familiar their activities were (Nexperience = 3,815). Greater activity familiarity was associated with smaller discrepancies in actual-ideal LAP, while greater activity pleasantness was associated with smaller discrepancies in actual-ideal HAP. These findings provide insights on the activities that help people achieve their ideal affect more easily. (shrink)

Our goal was to explore self‐care practices among men who have sex with men in the context of Mpox in Brazil. This study used qualitative research methods, including interviews and thematic analysis, to collect and analyze data from male participants across the Brazilian territory. The narratives unveil men's perspectives on self‐care, risk reduction, and health beliefs during the Mpox pandemic. Our findings highlight a multifaceted approach to self‐care among men, encompassing hygiene, physical contact management, mask usage, skin lesion vigilance, and (...) adherence to official guidelines. Men's attitudes toward sexual behaviors emphasize the importance of reducing sexual partners, practicing safe sex, and combating misinformation through accurate information dissemination. The development of these behaviors and self‐care practices can be facilitated by nurses guided by Dorothea Orem's Self‐Care Theory, supported by patient‐centered care, with strategies to address and confront the stigma associated with the disease and provide emotional support. Thus, the study underscores the pivotal role of self‐care in mitigating infection risks, especially in the context of emerging infectious diseases. It acknowledges the impact of socio‐cultural factors and healthcare policies on men's preventive measures. However, it also recognizes limitations, such as potential bias due to stigma concerns and a nonrepresentative sample. Ultimately, the research advocates for tailored education, promotion of gender equity, and healthcare empowerment to effectively manage health risks in such contexts. (shrink)

8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Trois sortes de définitions sont présentées et discutées: les définitions nominales, les définitions contextuelles et les définitions amplificatrices. On insiste sur le fait que I’elimination des definitions n’est pas forcement un procede automatique en particulier dans le cas de la logique paraconsistante. Finalement on s’int’resse à la théorie des objets de Meinong et l’on montre comment elle peut êrre considéréecomme une théorie des descripteurs.Three kinds of definitions are presented and discussed: nominal definitions, contextual definitions, amplifying definitions. It is emphasized that (...) the elimination of definitions is not necessarily straightforward in particular in the case of paraconsistent logic. Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Objective: To identify factors that predict physicians’ intent to comply with the American Medical Association’s ethical guidelines on gifts from the pharmaceutical industry.Methods: A survey was designed and mailed in June 2004 to a random sample of 850 physicians in Florida, USA, excluding physicians with inactive licences, incomplete addresses, addresses in other states and pretest participants. Factor analysis extracted six factors: attitude towards following the guidelines, subjective norms , facilitating conditions , profession-specific precedents , individual-specific precedents and intent. Multivariate regression (...) modelling was conducted.Results: Surveys were received from 213 physicians representing all specialties, with a net response rate of 25.5%. 62% of respondents were aware of the guidelines; 50% had read them. 48% thought that following the guidelines would increase physicians’ credibility and professional image; 68% agreed that it was important to do so. Intent to comply was positively associated with attitude, subjective norms, facilitators and sponsorship of continuing medical education events, while individual-specific precedents had a negative relationship with intent to comply. Predictors of intent were attitude, subjective norms, the interaction term , sponsorship of CME events and individual-specific precedents.Conclusions: Physicians are more likely to follow the AMA guidelines if they have positive attitudes towards the guidelines, greater subjective norms, fewer expectations of CME sponsorship and fewer individual-specific precedents. Physicians believing that important individuals or organisations expect them to comply with the guidelines are more likely to express intent, despite having fewer beliefs that positive outcomes would result through compliance. Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)

We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. Türk milleti dünyanın en zengin kültürüne sahip olduğu gibi en zengin diline de sahiptir. Ancak daha eski çağların dil verileri ne yazık ki, yazılı vesikalara aktarılmamış, karanlık dönem olarak kalmıştır. O bakımdan Türkçenin Altay veya Proto-Türk devri hakkında bilgimiz sınırlıdır ve sahip olduğumuz kelime sayısı da çok azdır. Eski Türkçe adlanan bu lügat sadece Orhun-Yenisey yazıtları ile tespit edilen ve Uygur yazıtları ile devam eden Türkçenin malum en eski yazılı kaynaklarının sözlüğüdür. Yer yüzündeki diller arasında Türkçenin yerine baktığımızda, Ural-Altay dil (...) grubunun Altay koluna bağlı bir dil olduğu ve geçmişinin M.Ö. 4000’li yıllara indiği görülür. Bu tarihten, M.Ö. 5. yüzyıla kadar olan dönem genel olarak Altay veya Proto-Türk devri olarak adlandırılır. Bu dönemde Türkçe ile ilgili az da olsa birtakım dil kalıntılarına rastlanır; ancak bunun yeterli olmaması ve bu dönemden bize yazılı herhangi bir metnin ulaşmaması, bu çağların karanlık dönem olarak adlandırılmasına neden olmuştur. Bu dönemde Türkçenin Çuvaşça ve Yakutça ile henüz ayrılmadığı, hattâ daha eskiye gittiğimizde Moğol, Mançu, Tunguz dilleriyle aynı çatı altında toplandığı varsayılır. Bilindiği gibi daha önce Eski Türkçe döneminin ayrı ayrı metinlerini kapsayan birçok sözlük çalışması yapılmıştır. Ancak bu sözlükler birbirinden bağımsız hazırlanmış, bir kısmı Göktürk dönemi ile Orhun Yazıtlarını, diğer bir kısmı da Uygur dönemi ile bu dönem metinlerini temel almıştır. Eski Türkçe bir bütün olarak düşünüldüğünde, bu sözlüklerin bazı yönlerden yetersiz kaldığı bir gerçektir. Bu çalışmanın genel amacı, daha önce ortaya konulan Eski Türkçe sözlükleri bir araya getirerek Göktürk ve Uygur dönemlerini birlikte ele alan, daha kapsamlı ve tek bir sözlük oluşturmaktır. O bakımdan daha önce meydana getirilen sözlük çalışmaları temel alınarak ortaya yeni bir sözlük konulmuştur. (shrink)

Bununla yanaşı orta əsrlərə dair tarixi, dini abidələrin, eləcə də yazılı mənbələr və tarixi şəxsiyyətlərə aid məlumatların üzə çıxarılması və qorunması da unudulmaz liderin başlıca vəzifələri sırasında idi. In der Erstausgabe des Denzinger-Enchiridion wurde in Anmerkung auf die Conciliorum collectio..., tom. I des P. J. Hardouin (...) S. J. hingewiesen: «die lateinischen und griechischen Theologen betonen: relatio... multiplicat personas in divinis» und im Nachsatz Anselm erwähnt. Background In the EU, clinical assessors, rapporteurs and the Committee for Medicinal Products for Human Use are obliged to assess the ethical aspects of a clinical development program and include major ethical flaws in the marketing authorization deliberation processes. To this date, we know very little about the manner that these regulators put this obligation into action. In this paper, we intend to look into the manner and the extent that ethical issues discovered during inspection have reached the deliberation processes. (...) Methods To gather data, we used the Dutch Medicines Evaluation Board database and first searched for the inspections, and their accompanying site inspection reports and integrated inspection reports, related to central marketing authorization applications of drugs submitted to the European Medicines Agency from 2011 to 2015. We then extracted inspection findings that were purely of ethical nature, i.e., those that did not affect the benefit/risk balance of the study. Only findings graded at least major by the inspectorate were included. Lastly, to identify how many of the ethically relevant findings reach the application deliberation processes, we extracted the relevant joint response assessment reports and reviewed the sections that discussed inspection findings. Results From 2011 to 2015, there were 390 processed applications, of which 65 had inspection reports and integrated inspection reports accessible via the database of the Dutch Medicines Evaluation Board. Of the 65, we found ERFs in 37. The majority of the ERFs were graded as major and half of the time it was informed-consent related. A third of these findings were related to research ethics committee processes and requirements. Of the 37 inspections with ERFs, 30 were endorsed in the integrated inspection reports as generally GCP compliant. Day 150 joint response assessment reports and Day 180 list of outstanding issues were reviewed for all 37 inspections, and none of the ERFs were carried over in any of the assessment reports or list of outstanding issues. Conclusion None of the ethically relevant findings, all of which were graded as major or critical in integrated inspection reports, were explicitly carried over to the joint assessment reports. This calls for more transparency in EMA application deliberations on how ERFs are considered, if at all, in the decision-making processes. (shrink)

This paper aims to outline the ethical concerns regarding the use of antidepressant medication in children and adolescents. Recent debates surrounding this issue have focused on the link between selective serotonin reuptake inhibitor use and an increased risk of suicidal thinking/behaviour, and weighed that against the benefit of the alleviation of depressive symptoms. It is argued here that such an approach is simplistic. There are several serious risks surrounding antidepressant use in the young that ought to be included in the (...) equation, along with a consideration of the neuroethical concerns surrounding pharmacotherapy for affective disorders. Using the precautionary principle as a framework for analysis it is concluded that the risks are sufficiently serious and plausible that the prescribing of antidepressant medication to the young ought to be severely restricted; further it is imperative that the child and their parents are made fully aware of the risks, short-term and long-term, involved. We observe that if ${\varphi :=\left[ \mathsf{P}=\mathsf{NP}\right] }$ and ${S:= \left[\digamma total\right] }$ , where ${\digamma=\digamma _{\mathsf{T}}}$ is da Costa-Doria “exotic” function with respect to T, then 4, 5 are satisfied for most familiar (presumably) consistent T in question, while ${\varphi _{S}}$ becomes equivalent to da Costa-Doria “exotic formalization” ${\left[ \mathsf{P}=\mathsf{NP}\right]^{\digamma}}$ . Moreover, the corresponding “exotic” inferences 1–3 generalize analogous da Costa-Doria results. Hence these “exotic” inferences are universal for all number-theoretic sentences and not characteristic to the conjecture P = NP. Hz. Peygamber’den nakledilen “Kim âşık olur da aşkını gizler, iffetli davranır ve bu sebepten ölürse, şehit olarak ölür” hadisinin sıhhati, hadis âlimleri arasında tartışma konusu olmuştur. İlk dönem hadis münekkitlerinin tamamı “âşık hadisi” hakkında olumsuz bir kanaat arz etmişlerken, sonraki dönem bazı hadis âlimleri birtakım deliller öne sürerek mezkûr rivayetin sahih olduğunu savunmuşlardır. Ancak yapılan araştırmalar sonucu sonraki dönem hadis âlimleri tarafından “âşık hadisinin” sahih olduğunu ispatlamak için ileri sürülen delillerin, hadisi sahih derecesine çıkartacak kadar kuvvetli olmadığı tespit edilmiştir. Bununla (...) birlikte mezkûr hadis araştırılırken müteahhir ulemadan bazı isimlerin mütekaddim münekkitlerin ittifakla ortaya koydukları bir hükme neden karşı çıktığı merak konusu olmuştur. Öte yandan makale bu sorunun cevabını ararken, müteahhir ulemâ arasından “âşık hadisine” sahih diyenlerin hadisin tenkidinde farklı bir yaklaşım ortaya koyduklarını tespit etmiştir. Onlar ilk dönem münekkitlerinin aksine hadisin ravisi Süveyd’i sika kabul etmişlerdir. Ayrıca getirdikleri farklı tarikler ile hadisin mevkûf rivayetlerini de “âşık hadisinin” sıhhatini ispatlamak için kullanmışlardır. (shrink)

Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. Labioplasty is a surgical procedure performed to alter the size and shape of the labia minora. The reasons for women requesting this procedure remain largely unknown and recently girls and young women under the age of 18 years have been requesting this type of surgery. This paper examines the ethical acceptability of performing this procedure on under 18s. We will first discuss whether labioplasty can be considered to be a therapeutic technique. We will claim that, while it is difficult to (...) offer a definitive definition of what constitutes a therapeutic technique, in our view labioplasty cannot be considered as such. This conclusion has relevance for the ethical acceptability of the procedure, its legal status in regard to the Female Genital Mutilation Act and the debates over who can give consent for it. It will be concluded that in our current state of knowledge, the benefits of labioplasty are far from clear, whereas the harms are demonstrable and therefore this procedure should not be offered to those aged under 18 years. Clinical decision making is a challenging task that requires practical wisdom—the practised ability to help patients choose wisely among available diagnostic and treatment options. But practical wisdom is not a concept one typically hears mentioned in medical training and practice. Instead, emphasis is placed on clinical judgement. The author draws from Aristotle and Aquinas to describe the virtue of practical wisdom and compare it with clinical judgement. From this comparison, the author suggests that a more complete understanding of clinical judgement (...) requires its explicit integration with goals of care and ethical values. Although clinicians may be justified in assuming that goals of care and ethical values are implicit in routine decision making, it remains important for training purposes to encourage habits of clinical judgement that are consciously goal-directed and ethically informed. By connecting clinical judgement to patients' goals and values, clinical decisions are more likely to stay focused on the particular interests of individual patients. To cultivate wise clinical judgement among trainees, educational efforts should aim at the integration of clinical judgement, communication with patients about goals of care, and ethical reasoning. But ultimately, training in wise clinical judgement will take years of practice in the company of experienced clinicians who are able to demonstrate practical wisdom by example. By helping trainees develop clinical judgement that incorporates patients' goals of care and ethical reasoning, we may help lessen the risk that ‘clinical judgement’ will merely express ‘the clinician's judgement.’.
